BUSINESS OMBUDSMAN MEETS KARAGANDY ENTREPRENEURS

Bolat Palymbetov, the Ombudsman for the Protection of the Rights of Entrepreneurs of Kazakhstan, took part in the meeting of the Council for the Protection of the Rights of Entrepreneurs of the "Atameken" National Chamber of Entrepreneurs of the Republic of Kazakhstan in the Karaganda region. Within the framework of the visit, a meeting with the akim of the region Yerlan Koshanov was also held.

During the meeting they discussed the complaints received by entrepreneurs about the actions of law enforcement agencies, as well as the problematic issues of initiating criminal cases by the Economic Investigation Service of the Department of State Revenues of Karaganda region.

As the chairman of the Council for the Protection of Entrepreneurs Rights and Counteracting Corruption of the "Atameken" NCE RK Kairbek Suleimenov noted, it is necessary to monitor the negative so that no tendency or pattern, where law enforcement agencies can get a negative effect from all of the above, can exist. Kairbek Suleimenov also stressed the importance of mutual cooperation between the Chamber and law enforcement bodies not only at the republican level, but also in the localities, regions and districts.

According to the practice, the complaints relate to the delay in the investigation of criminal cases against the actions of law enforcement officers and complaints about the actions of members of the local police service. As it turned out, in five cities out of nine in the region, a criminal case is initiated against an entrepreneur. It should be added that the Chamber of Entrepreneurs of the Karaganda region received 12 complaints to the bodies of internal affairs from 2015 to present year.

"The head of state set the task of decriminalizing economic crimes. In 2015, 80% of entrepreneurs were subjected to unreasonable criminal prosecution, that is, only 20% reached the court. As a result of the outstanding work done jointly with the Prosecutor General's Office, the number of criminal cases on economic violations has decreased five-fold in the past two years - from 8,170 cases in 2015 to 1,618 cases in 2017. And it is necessary to understand clearly - when a criminal case is initiated against entrepreneurs, and then a paper with the prescription "the case is closed because of the absence of the corpus delicti" is handed in, the first consequence is that the business loses the credit line in the bank. Second, the business will not be able to participate in any state programs. This red tape is simply not needed," - the business ombudsman Bolat Palymbetov explained.

According to his words, the initiation of a criminal case leads to bankruptcy of business.

However, as participants of the meeting noted, at present, entrepreneurs still have a threat of illegal bringing to criminal responsibility and as a result, they lose their business. The business itself wants openness and partnership from local executive bodies.

The meeting of the Council again raised the issue of the individual entrepreneur Madina Zhakupbekova, who won a tender for catering in the canteen in the Karaganda Academy of the Ministry of Internal Affairs of the Republic of Kazakhstan. However, in the implementation of full-fledged activities, businesslady are hindered by the leadership of the Academy. The meeting previously announced to send a letter to the Presidential Administration on the occasion.

In addition to its permanent members, the work of the Council was attended by representatives of state bodies, industry associations and regional businesses.

Within the framework of this trip, the Commissioner for the Protection of Entrepreneurs Rights of Kazakhstan also held a personal reception and heard all the problematic business appeals. In particular, entrepreneurs were worried about land issues, conducting inspections by state bodies and their results, legislative and tax issues.
